Kevin Magnussen faces exclusion from the United States Grand Prix after he is alleged to have exceeded the allotted 105kg of fuel permitted during a race.
Under the technical regulations for the 2018 season, the amount of fuel allowed for a race is 105kg.
Magnussen had finished in ninth place and could lose the two points for the Haas team, this would provide a further blow to the team as they are in a tight battle with Renault for fourth place in the constructors' championship.
In a statement released by FIA technical delegate Jo Bauer, the issue with the Dane's car had been sent to the stewards.
"Car 20, driver Kevin Magnussen, consumed more than 105kg of fuel, from the time at which the signal to start the race was given to the time the car had crossed the Line after the end-of-race signal had been given.
"As this is not in compliance with Article 30.5 of the 2018 Formula One Sporting regulations, I am referring this matter to the stewards for their consideration."
